News Update: EU Court Upholds Ruling Against AstraZeneca on Patents, Antitrust Rules

Jul 1, 2010 -- The European Union's second highest court upheld a ruling that AstraZeneca (AZN) misguided patent officials and ignored antitrust regulations to prevent a generic competitor from getting to market, according to a Bloomberg report. AstraZeneca shares are up $0.28, or 0.59%, to $47.41.

It is a leading producer of genetically engineered (GE) seed and of the herbicide glyphosate, which it markets under the Roundup brand. Founded in 1901 by John Francis Queeny, by the 1940s Monsanto was a major producer of plastics, including polystyrene and synthetic fibers. Notable achievements by Monsanto and its scientists as a chemical company included breakthrough research on catalytic asymmetric hydrogenation and being the first company to mass-produce light emitting diodes (LEDs). Actavis, finding that reverse payment settlements can sometimes be subject to antitrust scrutiny under the "rule of reason" standard. Post-Actavis, lower courts have provided further clarity to the Supreme Court's decision. For instance, in King Drug Co. v. SmithKline Beecham Corp (now GSK), the U.S. Court of Appeals for the Third Circuit held that reverse payments also encompass other forms or considerations not limited to cash. In another case, In re: Loestrin 24 Fe Antitrust Litigation, the U.S. Court of Appeals for the First Circuit explained that plaintiffs must provide facts sufficient to prove that the settlement at issue involves a large and unjustified reverse payment under Actavis. Similarly, In re: Actos End Payor Antitrust Litigation, the U.S. District Court for the Southern District of New York held that the complaint should sufficiently allege the payments as either large or unjustified. These and other cases decided since Actavis have impacted the reverse payment litigation practice. However, the question still remains as to how far and extensive the analysis of reverse payment cases will extend. Speaker: David Matas (B'nai Brith Canada) Various professional and international organizations have developed standards to avoid local complicity in foreign transplant abuse, such as receiving unethically sourced organs. This lecture will run through what those standards are. There is substantial evidence of transplant abuse in China. The standards will be applied, in the form of a case study, to indicate what can be done to avoid complicity in transplant abuse in China. I consider what professional, national and international institutions both have done and could do to reduce complicity. For professional institutions, the talk will address how the standards apply to The Transplantation Society and the World Medical Association. For international institutions, the talk will consider the standards in relation to the European Union, the World Health Organization, the United Nations High Commissioner for Human Rights and the UN Office for Drugs and Crimes. Mobile and Personal Technologies in Precision Medicine Workshop - July 27-28, 2015 - Day 1

On July 27 and July 28, the Precision Medicine Initiative (PMI) Working Group of the Advisory Committee to the NIH Director (ACD) hosted a public workshop on the scientific, methodological and practical considerations to inform the incorporation of mobile and personal technologies in the national research cohort of one million or more volunteers. The workshop will be was held at the Intel Corporation campus in Santa Clara, California, and was videocast. This workshop built on the unique scientific questions developed during the April 28–29 workshop, digital health data perspectives shared during the May 28-29 workshop, and the participant engagement and health equity discussions at the July 1-2 workshop. My advice is this: Settle! That's right. Don't worry about passion or intense connection. Don't nix a guy based on his annoying habit of yelling "Bravo!" in movie theaters. Overlook his halitosis or abysmal sense of aesthetics. Because if you want to have the infrastructure in place to have a family, settling is the way to go. Based on my observations, in fact, settling will probably make you happier in the long run, since many of those who marry with great expectations become more disillusioned with each passing year. (It's hard to maintain that level of zing when the conversation morphs into discussions about who's changing the diapers or balancing the checkbook.) Obviously, I wasn't always an advocate of settling. In fact, it took not settling to make me realize that settling is the better option, and even though settling is a rampant phenomenon, talking about it in a positive light makes people profoundly uncomfortable. Whenever I make the case for settling, people look at me with creased brows of disapproval or frowns of disappointment, the way a child might look at an older sibling who just informed her that Jerry's Kids aren't going to walk, even if you send them money. It's not only politically incorrect to get behind settling, it's downright un-American. Our culture tells us to keep our eyes on the prize (while our mothers, who know better, tell us not to be so picky), and the theme of holding out for true love (whatever that is—look at the divorce rate) permeates our collective mentality. Even situation comedies, starting in the 1970s with The Mary Tyler Moore Show and going all the way to Friends, feature endearing single women in the dating trenches, and there's supposed to be something romantic and even heroic about their search for true love. Of course, the crucial difference is that, whereas the earlier series begins after Mary has been jilted by her fiancé, the more modern-day Friends opens as Rachel Green leaves her nice-guy orthodontist fiancé at the altar simply because she isn't feeling it. But either way, in episode after episode, as both women continue to be unlucky in love, settling starts to look pretty darn appealing. Mary is supposed to be contentedly independent and fulfilled by her newsroom family, but in fact her life seems lonely. Are we to assume that at the end of the series, Mary, by then in her late 30s, found her soul mate after the lights in the newsroom went out and her work family was disbanded? If her experience was anything like mine or that of my single friends, it's unlikely. And while Rachel and her supposed soul mate, Ross, finally get together (for the umpteenth time) in the finale of Friends, do we feel confident that she'll be happier with Ross than she would have been had she settled down with Barry, the orthodontist, 10 years earlier? She and Ross have passion but have never had long-term stability, and the fireworks she experiences with him but not with Barry might actually turn out to be a liability, given how many times their relationship has already gone up in flames. It's equally questionable whether Sex and the City's Carrie Bradshaw, who cheated on her kindhearted and generous boyfriend, Aidan, only to end up with the more exciting but self-absorbed Mr. Big, will be better off in the framework of marriage and family. (Some time after the breakup, when Carrie ran into Aidan on the street, he was carrying his infant in a Baby Björn. Can anyone imagine Mr. Big walking around with a Björn?)
